A Session Court Dismisses Pre-Arrest Bail Application in a Coffee Spiking Death Case

A sessions court in Karachi on Thursday dismissed the pre-arrest bail application of a restaurant owner in an incident resulting in the death of a man after consuming coffee allegedly spiked with drugs.

The applicant had filed for pre-arrest bail before Additional District and Sessions Judge Ihsan Ali Malik, but his plea was rejected. The court stated that the applicant “failed to make out ulterior motive or mala fide intent on the part of the complainant or police” as a reason for confirming pre-arrest bail.

The complainant’s son died after drinking coffee provided by the accused at his restaurant in DHA phase 1 during a business deal.

According to counsel for the complainant, Zain Abbasi met with the applicant on July 31 and was served coffee that later resulted in his death. The post-mortem report indicated caffeine, methamphetamine, and cannabis presence in Abbasi’s body, suggesting these substances were ingested through food consumed at the restaurant.

The applicant’s counsel pointed out CCTV footage showing the deceased leaving the restaurant in a healthy state but acknowledged that his client was unaware of what happened afterward. The prosecutor argued against this defense, stating there’s evidence of tampering with the CCTV footage by the suspect, indicating intent to conceal their actions.

The case falls under Sections 302 (murder) and 34 (common intention) of the Pakistan Penal Code.
